भारतीय संविधान के भाग: पहले, संविधान में 395 अनुच्छेद शामिल थे जो 22 भागों और 8 अनुसूचियों में विभाजित थे। हालाँकि, वर्तमान में, 448 अनुच्छेद 25 भागों और 12 अनुसूचियों में विभाजित हैं। क्रमांकन वही रहता है लेकिन जब भी संविधान में संशोधन किया जाता है, तो मूल लेखों के नीचे ए, बी, सी आदि प्रत्ययों के साथ नए लेख जोड़ दिए जाते हैं। उदाहरण के लिए, जब शिक्षा के अधिकार को समायोजित करने के लिए हमारे संविधान में संशोधन किया गया था, तो एक नया अनुच्छेद 21ए जोड़ा गया था। अनुच्छेद 21 के नीचे डाला गया। यह लेख भारतीय संविधान के भागों के साथ-साथ उनके विषयों और अनुच्छेद संख्याओं पर चर्चा करता है।
भारतीय संविधान के भाग
संविधान में भारत को राज्यों के संघ के रूप में संदर्भित किया गया है, जिसका अर्थ है कि इसकी एकता अटूट है। भारतीय संघ का कोई भी भाग अलग नहीं हो सकता। देश को कई भागों में विभाजित किया गया है जिन्हें राज्य या केंद्र शासित प्रदेश कहा जाता है और संविधान न केवल केंद्र सरकार की संरचना बल्कि राज्य सरकार की संरचना भी निर्धारित करता है। भारतीय संविधान के भाग I में अनुच्छेद 1 से 4 शामिल हैं जो संघ और उसके क्षेत्र से संबंधित है। भाग II में अनुच्छेद 5 से 11 शामिल हैं और यह नागरिकता से संबंधित है। भारतीय संविधान के विभिन्न भागों के बारे में जानने के लिए पृष्ठ को स्क्रॉल करें।
भारतीय संविधान के भाग विस्तार से
आइए नीचे चर्चा की गई सामग्री से भारतीय संविधान के सभी भागों को विस्तार से समझें-
भाग I: संघ और उसका क्षेत्र (अनुच्छेद 1 से 4)
देश को 28 राज्यों और 8 केंद्र शासित प्रदेशों में बांटा गया है। राष्ट्रपति केंद्र शासित प्रदेशों की देखरेख के लिए एक प्रशासक की नियुक्ति करता है। प्रत्येक भारतीय राज्य/केंद्र शासित प्रदेश की अपनी जनसांख्यिकी, इतिहास, संस्कृति, पोशाक, भाषा इत्यादि होती है। भारतीय संविधान के भाग I में निम्नलिखित अनुच्छेद शामिल हैं:
- अनुच्छेद 1: संघ का नाम और क्षेत्र।
- अनुच्छेद 2: नये राज्यों की स्थापना.
- अनुच्छेद 3: नए राज्यों का गठन और मौजूदा राज्यों के क्षेत्रों, सीमाओं या नामों में परिवर्तन।
- अनुच्छेद 4: पहली और चौथी अनुसूची और पूरक, आकस्मिक और परिणामी मामलों में संशोधन प्रदान करने के लिए अनुच्छेद 2 और 3 के तहत कानूनों का निर्माण किया गया था।
भाग II: नागरिकता (अनुच्छेद 5 से 11)
भारतीय संविधान के भाग II के तहत, नागरिकता अनुच्छेद 5 से 11 के अंतर्गत आती है। अनुच्छेद 5 से 8 वर्णन करते हैं कि संविधान के प्रारंभ के समय भारतीय नागरिकता के लिए कौन पात्र था, और अनुच्छेद 9 से 11 वर्णन करता है कि नागरिकता कैसे प्राप्त की जाती है और खो गया।

भाग III: मौलिक अधिकार (अनुच्छेद 12 से 35)
भारतीय संविधान के भाग III (अनुच्छेद 12 से 35) में हमारे संविधान में मौलिक अधिकार और उपचार हैं जिनका उल्लंघन किया गया है। लोकतांत्रिक संविधान में इन अधिकारों को शामिल करने के पीछे प्राथमिक तर्क यह है कि व्यक्तियों को कभी-कभी दूसरों द्वारा की गई अनुचित हिंसा से सुरक्षा की आवश्यकता होती है। अनुच्छेद 14 से 35 में मौलिक अधिकारों को छह समूहों में वर्गीकृत किया गया है-
- समानता का अधिकार (अनुच्छेद 14 से 18)

भाग IV: निदेशक सिद्धांत (अनुच्छेद 36 से 51)
हमारे संविधान के भाग IV, निदेशक सिद्धांत (अनुच्छेद 36- 51), ये लेख पूरी तरह से राज्य के नीति निदेशक सिद्धांतों, भारतीय संविधान में इसके महत्व और मौलिक अधिकारों के साथ इसके संघर्ष के इतिहास पर आधारित हैं। इसमें समान नागरिक संहिता का कार्यान्वयन, अस्पृश्यता का उन्मूलन, महिलाओं पर अधिकृत विकलांगताओं को हटाना आदि शामिल हैं। अनुच्छेद सूचियाँ इस प्रकार हैं:

भाग IV ए: मौलिक कर्तव्य (अनुच्छेद 51 ए)
अनुच्छेद 51ए में 11 मौलिक कर्तव्य हैं जिनका पालन प्रत्येक नागरिक को करना होता है। वे हैं-
- संविधान का पालन करना और उसके आदर्शों और संस्थानों, राष्ट्रीय ध्वज और राष्ट्रगान का सम्मान करना।
- उन महान आदर्शों का पालन करना और उन्हें संजोना, जिन्होंने स्वतंत्रता के लिए हमारे राष्ट्रीय संघर्ष को प्रेरित किया।
- भारत की संप्रभुता, एकता और अखंडता को बनाए रखना और उसकी रक्षा करना।
- देश की रक्षा करना और आवश्यकता पड़ने पर राष्ट्रीय सेवा प्रदान करना।
- धार्मिक, भाषाई और क्षेत्रीय या अनुभागीय विविधताओं से परे भारत के सभी लोगों के बीच सद्भाव और समान भाईचारे की भावना को बढ़ावा देना; महिलाओं की गरिमा के लिए प्रथाओं का त्याग करना।
- हमारी प्रतिष्ठित संस्कृति की समृद्ध विरासत को महत्व देना और संरक्षित करना।
- वनों, झीलों, नदियों और वन्य जीवन सहित प्राकृतिक पर्यावरण की रक्षा और सुधार करना और जीवित प्राणियों के प्रति दया रखना।
- वैज्ञानिक दृष्टिकोण, मानवतावाद तथा जिज्ञासा एवं सुधार की भावना का विकास करना।
- सार्वजनिक संपत्ति की रक्षा करना और हिंसा का त्याग करना;
- व्यक्तिगत और सामूहिक गतिविधि के सभी क्षेत्रों में उत्कृष्टता की दिशा में प्रयास करना ताकि राष्ट्र लगातार प्रयास और उपलब्धि के उच्च स्तर तक बढ़ सके;
- माता-पिता या अभिभावकों को अपने छह से चौदह वर्ष की आयु के बच्चों को शिक्षा के अवसर प्रदान करने चाहिए।
भाग V: संघ (अनुच्छेद 52 से 151)
अध्याय I –कार्यपालिका (अनुच्छेद 52 से 78)
कार्यकारिणी में भारत के राष्ट्रपति, उपराष्ट्रपति, मंत्रिपरिषद और अटॉर्नी जनरल के चुनाव, शपथ, योग्यताएं और सभी कर्तव्य शामिल हैं।
अध्याय II –संसद (अनुच्छेद 79 से 122)

भाग VII-कांस्टेबल द्वारा निरस्त पहली अनुसूची के बी भाग में राज्य। (7वां संशोधन) अधिनियम, 1956 [अनुच्छेद-238 (निरस्त)]
भारतीय संविधान के 22 भागों में से एकमात्र भाग जिसे हटा दिया गया है वह भाग VII है। इसे संविधान (7वां संशोधन) अधिनियम 1956 द्वारा निरस्त कर दिया गया था। इसलिए, 7वें संशोधन ने भाग VII को हटा दिया, जो भाग बी राज्यों से संबंधित था, अब हटा दिया गया है।
भाग VIII- केंद्र शासित प्रदेश (अनुच्छेद 239 से 242)
दिल्ली के संबंध में विशेष प्रावधान, 239 ए, 239 एए और 239 एबी के दो अनुच्छेद जोड़े गए। ये अनुच्छेद केंद्र शासित प्रदेशों के प्रशासन और (अनुच्छेद 242) निरस्त कर दिए गए।
भाग IX-पंचायतें (अनुच्छेद 243 से 243O)
(अनुच्छेद 243 से 243ओ) हमें पंचायत की परिभाषा, संविधान, संरचना, आरक्षण और अवधि के बारे में जानकारी बताता है। पंचायत की शक्तियाँ, उनकी शक्तियाँ, चुनाव, पंचायत के खातों की लेखापरीक्षा, चुनावी मामलों में अदालत के हस्तक्षेप पर रोक। प्रत्येक पंचायत 5 वर्ष की कार्यकाल अवधि जारी रखेगी।
भाग IX A- नगर पालिकाएँ (अनुच्छेद 243P से 243ZG)
1992 का संविधान (74वां संशोधन) अधिनियम, शहरी स्वशासन की संरचना, संरचना, शक्तियों और कार्यों को स्थापित करता है। नगर निकाय पाँच प्रकार के होते हैं –

भाग IX B-सहकारी समितियाँ (अनुच्छेद 243ZH से 243ZT)
सहकारी समितियाँ स्वयं सहायता संगठन का एक उदाहरण हैं। यह भारतीय संविधान की प्रस्तावना में संकल्पित सामाजिक और आर्थिक न्याय के लक्ष्य को प्राप्त करने के साथ-साथ लोगों को पूंजीवादी शोषण से बचाने के लिए एक महत्वपूर्ण और प्रमुख उपकरण है। भाग IX-A के बाद, अनुच्छेद 243ZH से 243ZT सहित एक नया भाग IX B, 2011 के संविधान (97वें संशोधन) अधिनियम में शामिल किया गया था। नया खंड सहकारी समितियों पर केंद्रित है।
भाग X- अनुसूचित और जनजातीय क्षेत्र (अनुच्छेद 244 से 244ए)
(अनुच्छेद 244) अनुसूचित क्षेत्रों और जनजातीय क्षेत्रों के प्रशासन के लिए है।
(अनुच्छेद 244ए) असम में कुछ आदिवासी क्षेत्रों को मिलाकर एक स्वायत्त राज्य के गठन से संबंधित है।
भाग XI- संघ और राज्यों के बीच संबंध (अनुच्छेद 245 से 263)
अध्याय I –विधायी संबंध (अनुच्छेद 245 से 255)
संघ और राज्यों के बीच विधायी शक्तियों का क्षेत्रीय विभाजन संविधान के अनुच्छेद 245 में वर्णित है। संघ को भारत के संपूर्ण या उसके किसी भाग के लिए कानून बनाने का अधिकार है, जबकि प्रत्येक राज्य को अपने क्षेत्र के लिए कानून बनाने की शक्ति है। भारत के वर्तमान संविधान ने भारत सरकार अधिनियम, 1935 की वितरण योजना को अपनाया है। संविधान की सातवीं अनुसूची में तीन सूचियाँ आती हैं। सूची I में 97 आइटम शामिल हैं जिन पर केंद्रीय संसद को पूर्ण अधिकार है। सूची II में 66 आइटम हैं जिन पर राज्यों के पास विशेष शक्ति है, जबकि सूची III, समवर्ती सूची में 47 आइटम हैं जिन पर केंद्रीय संसद और राज्य विधानमंडल दोनों कानून बना सकते हैं।
अध्याय II –प्रशासनिक संबंध (अनुच्छेद 256 से 263)
इन अनुच्छेदों में राज्य एवं संघ के दायित्वों का उल्लेख किया गया है। अनुच्छेद 257 ए और अनुच्छेद 259 को निरस्त कर दिया गया। अनुच्छेद 262 में जल से संबंधित विवाद अर्थात अंतरराज्यीय नदियों या नदी घाटियों के जल से संबंधित विवादों का न्यायनिर्णयन किया गया है। अनुच्छेद 263 हमें अंतर-राज्य परिषद के संबंध में प्रावधान देता है।
भाग XII-वित्त, संपत्ति, अनुबंध और मुकदमे (अनुच्छेद 264 से 300ए)
अध्याय I –वित्त (अनुच्छेद 264 से 291)
ये लेख भारतीय राज्यों की संपत्तियों, परिसंपत्तियों, अधिकारों, देनदारियों, करों और कर्तव्यों से संबंधित हैं।

अध्याय IV –संपत्ति का अधिकार (अनुच्छेद 300A)
1978 का संविधान (44वां संशोधन) अधिनियम संपत्ति के अधिकार को मौलिक अधिकार के रूप में समाप्त कर देता है, हालांकि यह एक कल्याणकारी राज्य में एक मानव अधिकार और संविधान के अनुच्छेद 300 ए के तहत एक संवैधानिक अधिकार बना हुआ है। अनुच्छेद 300ए में कहा गया है कि किसी की संपत्ति उनसे तब तक नहीं छीनी जा सकती जब तक कि उनके पास कानूनी प्राधिकरण न हो।
भाग XIII- भारत के क्षेत्र के भीतर व्यापार, वाणिज्य और संभोग (अनुच्छेद 301 से 307)
भारतीय संविधान का भाग XIII (अनुच्छेद 301 से 307) व्यापार, वाणिज्य और संभोग की स्वतंत्रता प्रदान करता है। (अनुच्छेद 301) व्यापार और वाणिज्य के व्यापक सिद्धांतों और शक्तियों को दर्शाता है। अनुच्छेद 302 से 305 व्यापार निषेधों की गणना करते हैं। व्यापार का अर्थ है लाभ के लिए उत्पाद खरीदना और बेचना। ‘व्यापार’ शब्द को अनुच्छेद 301 में ‘एक विशिष्ट लक्ष्य या उद्देश्य के साथ वास्तविक, संगठित और संरचित गतिविधि’ के रूप में परिभाषित किया गया है। जबकि हवा, पानी, टेलीफोन, टेलीग्राफ, या किसी अन्य मीडिया के माध्यम से आंदोलन के प्रसारण को संदर्भित किया जाता है। ‘वाणिज्य’ के रूप में, उत्पादों का एक स्थान से दूसरे स्थान पर स्थानांतरण ‘इंटरकोर्स’ के रूप में जाना जाता है।
- भाग XIV- संघ और राज्यों के अधीन सेवाएँ (अनुच्छेद 308 से 323)
- (अनुच्छेद 308 से 314) – संघ या राज्य की सेवा करने वाले व्यक्ति की भर्ती और सेवा की शर्तों, उसके कार्यकाल, निष्कासन और संक्रमणकालीन प्रावधानों से संबंधित है। यह अखिल भारतीय सेवाओं से भी संबंधित है।
